Who these terms are between
These terms are between WPops Land Ltd, company number 17526619, registered office 18 Chippendale Close, High Wycombe HP13 6BT, and you, the organisation or person who orders hosting. Where they say “I” or “me”, they mean the company and Christian Ashby, who runs it. You accept them when you order or start using the service.
The service is meant for businesses, charities, schools and other organisations. If you buy it as a private individual, your rights as a consumer under UK law still apply.
What the service is
WPops Land is managed hosting for WordPress and static sites, run by me on Google Cloud in London. The pricing page lists what each plan includes.
I don’t write your content, and design and development work isn’t part of hosting. Bespoke apps, such as portals, registers and booking systems, are quoted per project and have their own agreement.
Plans, prices and payment
- WordPress hosting is £25 a month for one production site, with free staging copies.
- Each extra production WordPress site costs £20 a month.
- Static sites cost £5 a month.
WPops Land Ltd invoices monthly in advance. Each invoice is due within 30 days of its date, and you can pay by bank transfer, by card or by a scheduled card payment. If I change a price, I tell you in writing at least 30 days before the new price applies, and I won’t raise your price during your six-month minimum term.
Term, notice and refunds
The minimum term is six months from the date you order. After that the plan runs month to month. You can give notice at any time through the dashboard or the contact page, and the plan ends 30 days later, or at the end of the minimum term if that is later.
If the hosting isn’t working for you in the first 30 days, for any reason, I refund the rest of what you’ve paid.
Migrations
Your first migration is free. Each one after that costs £50. To move a site I need access to your current host or a copy of the site’s files and database, and we agree together when to switch your domain over.
What I do
- Keep WordPress, plugins and themes up to date. If an update causes a problem, I put it right or restore from a backup.
- Back up your database, files and media every night and keep each backup for 28 days. You can take a snapshot from the dashboard before a risky change, and I restore a snapshot or backup when you ask.
- Check your site every 5 minutes and get an alert when it stops responding.
- Keep the WordPress login behind Google sign-in, run a web application firewall in front of every site, and renew HTTPS certificates.
- Answer support. You raise tickets from the dashboard, by email or by phone on 020 3422 9767. I reply to questions and requests within 24 hours. If your site is down, I start on it straight away.
What you do
- Make sure what you publish is lawful and that you have the rights to use it.
- Hold your own licences for premium plugins and themes, and give me the keys so I can install and update them.
- Keep the Google accounts that can reach your site secure, with two-step verification, and tell me when someone should lose access.
- Tell me promptly about anything that looks wrong, including a suspected security problem.
- Pay invoices when they are due.
- Be the data controller for your site. You decide what personal data your site collects, from visitors, customers or members, you hold the lawful basis and any consents it needs, you publish your own privacy notice and cookie banner, and you answer requests from the people the data is about. WPops Land Ltd processes that data only on your instructions, as the privacy notice sets out.
I am not responsible for the content you publish, for how your site collects or uses personal data, or for the legal and privacy consequences of either. If I receive a complaint or a legal request about your site, I pass it to you to answer. I act on it myself only where the law or the acceptable use rules require me to.
Acceptable use
The plans are for normal websites: business sites, shops, blogs, portfolios and similar. You must not use the service for anything illegal, to host malware, phishing or abusive content, to send bulk email, or to run crypto mining, proxies, file sharing or game servers. You must not attack the platform or try to reach other customers’ data. The £25 plan fits sites with up to about 10 GB of files and the traffic a small organisation normally sees. If your site needs more, I’ll work out a plan that fits with you.
The fair use policy has the full list. If something breaks it, I tell you and give you time to fix it. I act at once, without notice, for illegal content, an active attack or a court order.
Your content
Your site and everything on it stays yours. You are responsible for what you publish on it. You give the company permission to copy and store it only as far as it needs to host, back up and support your site.
The platform
The platform, the dashboard and the tools I built remain the company’s. When you leave, I give you a copy of your site’s files and database to take wherever you like, and I help you move your domain. There’s no exit fee.
Service levels and outages
I don’t offer an uptime guarantee. Guarantees like that don’t keep a site or a business running; monitoring does. I watch every site constantly and tell you as soon as something happens. Where an outage is within my control, I work on it straight away until it’s fixed.
Production sites run as two copies. A checker in a different Google region tests each site every 5 minutes and alerts me after three failures in a row, and your dashboard shows 90 days of uptime history. Many sites are also checked by an outside service from several locations.
I’m not responsible for delays caused by events outside my reasonable control, such as a failure at Google Cloud, but I keep working to bring your site back.
Liability
The company’s total liability to you under these terms in any 12 months is limited to the fees you paid in the 12 months before the claim. The company is not liable for loss of profit, revenue or business, or for indirect losses.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
Suspension and ending the service
I can suspend a site if an invoice is more than 14 days overdue after I have reminded you, if the site breaks the acceptable use rules, or if it puts the platform or other customers at risk. I tell you first unless the problem is urgent, and I bring the site back once it is resolved.
Either of us can end the service if the other seriously breaks these terms and doesn’t put it right within 14 days of being told. I can also end the service for any reason with 90 days’ notice, and I help you move.
Data protection
The privacy policy explains what the company does with your data. For the personal data of your site’s visitors, you are the controller and WPops Land Ltd is your processor. As your processor, the company:
- processes that data only on your instructions, which are these terms and the requests you make, unless the law requires otherwise;
- makes sure anyone with access to it is bound by confidentiality;
- keeps it secure with the measures described on the hosting pages;
- uses only the sub-processors listed in the privacy policy, and tells you before adding a new one so you can object;
- helps you answer requests from the people the data is about, and tells you without undue delay about any breach that affects your data;
- gives you the information you need to show the data is handled lawfully;
- when the service ends, gives you a copy of your site and deletes the data within 30 days, with the last backups expiring 28 days later.
Changes to these terms
If I change these terms, I email customers at least 30 days before the change takes effect. If you don’t accept a change, you can end the plan before it applies without paying for the rest of the minimum term.
Law and courts
These terms are governed by the law of England and Wales, and the courts of England and Wales deal with any dispute.
